Update: Seafood Import Monitoring Program (SIMP) Informed Compliance Ending on April 7, 2018

U.S.  Customs and Border Protection (CBP) and National Marine Fisheries Service (NMFS) announced that all filings covered by the Seafood Import Monitoring must fully comply with the elecronic filing requirements beginning April 7, 2018.

NMFS initially adopted an “informed compliance” approach, working with CBP and filers to facilitate the transmission of SIMP data elecronically in ACE without impeding the release and clearance of shipments which entry filer had incomplete information or was unable to successfully submit the data at the time of entry.

According to NOAA/NMFS, due to the increasing rate of compliance with SIMP filings, the informed compliance approach will end on April 7, 2018. More so, in the final rule under Federal Register Document#2016-29324, record retention period of 2 years is required.

Flegenheimer International would like to remind importers and shippers to keep sending accurate and complete information along with their shipping documents in timely manner; otherwise shipments with incomplete or incorrect data will not get a “May Proceed’ from NMFS.

SIMP established reporting and recordkeeping requirements for imports of certain seafood products to prevent illegal, unreported and unregulated and/or misrepresented seafood from entering U.S.
