Latest News: Import Requirements from Partner Government Agencies


We are pleased to announce that Flegenheinmer International has been one of the most active brokers participating in the transition of U.S. Customs and Border Protection to a Single Window with Partner Government Agencies. In our previous newsletters, we have advised you that most of the paper requirements for processing your entries are now being automated. Due to this reason, there are various documentation and information that now needs to be transmitted to CBP prior to getting a release.

For instance, if you have a shipment that needs to be cleared and you forgot to send us a phytosanitary certificate, USDA Import Permit, or NOAA Form 370, etc, we used to be able to transmit your entry to customs system while we wait for the missing paperwork. The new ACE system will not let us transmit an entry without the required documentation; therefore, it is extremely important that we have all required documentation prior to submitting your entry to avoid any delays.

Below are some requirements from Partner Government Agencies that we need to have in order to transmit an entry:

APHIS Core (USDA) – TBD 2016

– USDA Import Permits, Health Certificates, Phytosanitary Certificates must be sent in advance. The permit and certificate numbers are now required to be entered in our system vs manual paperwork submission only. This is in addition to original documents that will still continue to be submitted such as Phytosanitary Certificates, Veterinary Certificates, etc.

– Statement of the Intended Use of the Commodity is one of the most important requirements.

– Genus & Species name must be provided

APHIS Lacey Act – March 2016

– A Completed PPQ FORM 505

Fish & WIldlife (FWS) – TBD 2016

– F&W Import License and CITES Permits

– Statement of the Intended Use of the Commodity is one of the most important requirements.

Federal Communications Commission (FCC)  – December 2016

Earlier this year, a publication was sent by FCC from Washington D.C. announcing that the FCC requirements for importation of Radio Frequency (RF) devices  will be temporarily waived until December 31, 2016. This is due to the discontinuation of ACS system on July 23,2016 and the information on Form 740 has not yet been accommodated in the new ACE system.

Flegenheimer International would like to emphasize that even though the requirements are waived, it is the importer’s responsibility to retain the Form 740 and any FCC certification, it must be readily available upon request by CBP or FCC.

NMFS (National Marine Fisheries Services) – September 2016

– International Trade Permit (ITP)# is now required and we suggest providing us a copy along with  NOAA 370 and Captain Statements for Frozen/Prepared Tuna and ICCAT for Bluefin, swordfish and Frozen Bigeye.
